JP Morgan Chase Bank named in action by Financial Service Representatives


This blog is for informational purposes about a pending California class action lawsuit and how you can participate if interested.

The case is entitled Michelle Nguyen JP Morgan Chase, Orange County Superior Court Case No. 30-2012-00547344-CU-OE-CXC.

Ms. Nguyen was employed by the predecessor of JP Morgan Chase in 1989 and was terminated in June of 2010. She worked in a non-exempt position as a Financial Service Representative and Teller.  Ms. Nguyen, like members of the aggrieved class, are non-exempt employees in the state of California: who worked more than eight (8) hours in any given day and/or more than forty (40) hours in any given week, and are not paid straight time or overtime compensation due to unlawful “time banking” policies, deletion or manipulation of time in the electronic time keeping system; who did not receive an uninterrupted ten (10) minute rest period for every four (4) hours worked in any given workday; and, who worked more than five (5) hours in any given day but did not receive a lawful meal period of at least 30 minutes on that day.  In addition, JP Morgan Chase failed to provide itemized wage statements accurately reflecting total hours worked, the applicable hourly rates in effect during the pay period, and the corresponding number of hours worked at each hourly rate.  Finally, employees who incurred expenses for the employer were not reimbursed these expenses. Employees who worked as tellers and ended the day with the drawers short, had their wages unlawfully deducted by JP Morgan Chase to cover the missing money, a violation of public policy here in California. We are currently investigating other potential violations.  The conduct of JP Morgan Chase allows them to unfairly compete in the California market.
